Hit by Door - Bicycle Injuries

$2.25 Million

The Law Firm of Richard L. Duquette and Trial Lawyers for Justice Trial Teams obtained a $2,250,000 settlement for a San Diego County bicyclist who was “doored”. The incident occurred on a street without a marked bicycle lane or sharrows.

On October 10, 2019 a bicyclist violently hit her head on the street, causing her multiple brain bleeds, and a fractured finger. The defendant was in the course and scope of employment at the time of the crash.

Plaintiff’s counsel hired a medical illustrator who’s 3D images graphically depicted the brain injuries. Also, Plaintiff’s roster of expert witness proved her injuries were caused by the force of her fall, despite not wearing a helmet.

Plaintiff expressed her gratitude to her Trial Attorneys and authorized this public statement:

“I want to thank you and your team for the time, hard work and personal care in my case. You have been by my side every step of the way in our two-year journey for justice in my bicycle injury case. I am so grateful for the consistent communication and expertise you have provided.

My life of cycling, outdoor activities, work and social life came to a stop on October 10, 2019. You provided the experts, medical care and specialists for my many needs from the brain injury and physical injuries. You and your team helped me navigate through the recovery process with such compassion and care. Thank you for the dedication and attention to every detail to provide me with the best outcome. I now have hope for a better future and the comfort of knowing I have the ability to obtain the care I need. Forever grateful”

“Unfortunately, this type of tragic incident occurs when inattentive motorists illegally fling open their car doors, without carefully looking for bicyclists.” Said Mr. Duquette, Team Co-Counsel.

The settlement was reached following a day long mediation with private mediator Robert Tessier. For the Plaintiff bicyclist were Trial Attorneys Nick Rowley, Haytham Faraj and Richard L. Duquette, trained at the Thunderhead Ranch in Wyoming by renowned trial Lawyer Gerry Spence. Attorneys Katherine Melik-Stepanyan, Stephanie Herrick and Mike Norton provided essential support to this settlement.

The defense was represented by Michael Rogers, Esq. and Robin Smith, Esq. of Balestri, Potocki & Holmes, Law Corporation.
