10 Days to Save Your License

Requesting a Restricted License in California

Driving under the influence (DUI) is a grave offense in the state of California. Every year, thousands of individuals suffer serious injuries in accidents that involve alcohol. That is why anyone who is arrested under charges of DUI faces serious penalties. The first consequence of a DUI arrest is admin per se (APS) license suspension. When an individual is arrested for DUI, their arresting officer will confiscate their license and issue a temporary permit that allows the individual to operate a vehicle for the next 10 days. Once that permit expires, the individual's license suspension is effective until the outcome of their future criminal DUI hearing. In order to restore their license, the arrested individual must request a DMV hearing within 10 days of their arrest.

Act now to restore your driver's license!

If you have been charged with drunk driving, you cannot afford to wait when it comes to legal counsel. The process of requesting a hardship license is not simple or commonly understood. With an Oceanside attorney by your side to counsel and represent you throughout the process, you stand a much better chance of regaining your right to drive until your criminal case is complete. At a DMV hearing, you have the ability to argue your defense before an administrative judge and prove that your suspension was undeserved. Your suspension may then be reversed. If your future criminal case results in a conviction, however, your license will be irrevocably suspended per criminal law.

The first step in saving your license is to file a Form DS-694, Application for Critical Need Restriction with the California DMV. You must also provide proof of financial responsibility (SR-22), proof of enrollment in a DUI program, and a $125 reissue fee along with your request for a restricted license. The purpose of a hardship license is to ensure that you can continue working while your criminal verdict is pending. Your SR-22 and application for a restricted license are meant to prove that you and your family (when applicable) will suffer undue hardship due to your suspended license. The Law Firm of Richard L. Duquette can provide excellent guidance and aggressive defense as you seek to save your driver's license and to fight your DUI.
